Welcome to Rapid Roadside Rescue Austria. These Terms and Conditions ("Terms") govern your use of our 24/7 roadside assistance services in Austria. By accessing or using our services, you agree to be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

By requesting or receiving services from Rapid Roadside Rescue Austria, you acknowledge that you have read, understood, and agree to be bound by these Terms and any applicable laws and regulations. If you do not agree with any part of these Terms, you must not use our services.

2. Services Provided

Rapid Roadside Rescue Austria offers 24/7 emergency roadside assistance services within our specified coverage areas in Austria. Our services include, but are not limited to:

• Towing services for disabled vehicles.
• Jump-start services for vehicles with dead batteries.
• Tire change services (requiring a serviceable spare tire provided by the customer).
• Fuel delivery (customer pays for fuel cost).
• Lockout services.

The availability of specific services may vary based on location, vehicle type, and prevailing conditions. While we strive for immediate response, exact arrival times cannot be guaranteed due to traffic, weather, or other unforeseen circumstances.

3. Service Request and Payment

To request service, you must contact us via our designated emergency contact methods. By requesting service, you authorize Rapid Roadside Rescue Austria to dispatch a service vehicle and perform the necessary assistance.

Payment for services will be agreed upon prior to dispatch or upon arrival, as determined by the specific service and situation. You are responsible for all costs associated with the services rendered. We accept various forms of payment, which will be communicated at the time of service request. Failure to pay for services may result in legal action to recover outstanding amounts.

4. Your Responsibilities

As a user of our services, you agree to:

• Provide accurate and complete information regarding your location, vehicle, and the nature of the emergency.
• Remain in a safe location until our service personnel arrive.
• Ensure your vehicle is accessible and safe for our personnel to work on.
• Comply with all instructions given by our service personnel.
• Be present with your vehicle unless otherwise arranged with our dispatch or service personnel.

5. Limitation of Liability

Rapid Roadside Rescue Austria will exercise reasonable care in the provision of its services. However, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use our services;
• Any conduct or content of any third party on our service;
• Any damage to your vehicle or property that occurs despite our reasonable care, unless caused by gross negligence or willful misconduct on our part.

Our maximum liability to you for any services provided shall not exceed the amount paid by you for those specific services.

6. Indemnification

You agree to defend, indemnify, and hold harmless Rapid Roadside Rescue Austria and its employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use of our services or your breach of these Terms.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of our services after any revisions become effective signifies your acceptance of the revised Terms.

8. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Austria, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Austria.
